What is the Fair Labor Standards Act (FLSA)?
The FLSA is designed to protect workers from the predatory practices of employers when it comes to overtime compensation. In general, the ACT mandates that employers provide fair pay for all hours worked that are in excess of 40 per workweek. Employees are to be paid one and one-half times their regular hourly wage. That means if you earn $15 an hour and work more than 40 hours in a particular workweek, you would be owed $22.50 ($15 plus $7.50) for each extra hour.
There are some instances where an employer is exempt from having to follow the FLSA. When you speak with your attorney, he or she will be able to let you know whether or not the exemption applies to the company you work for. If the employer is not exempt, however, and found to be in violation of the FLSA, you could be eligible to receive double the amount of money you had coming. If you’ve been working overtime for years without receiving proper compensation, you may be looking at thousands of dollars.
